Terms & Conditions
1. Introduction
These Terms and Conditions ("Terms") constitute a legally binding agreement between Empire State Movers ("the Company") and the client ("the Client") for the provision of moving services within Dubai, United Arab Emirates.
2. Definitions

Company: Refers to Empire State Movers.

Client: The individual or entity requesting and receiving services from the Company.

Goods: All items, belongings, and property that the Client has entrusted to the Company for relocation.

Services: Encompasses packing, loading, transportation, unloading, unpacking, storage, and any additional services agreed upon in writing.
3. Scope of Services
3.1. The Company agrees to perform the Services as detailed in the written quotation or service agreement provided to the Client.
3.2. Any additional services requested by the Client not specified in the original agreement shall be subject to additional charges and must be agreed upon in writing prior to execution.
4. Quotations and Estimates
4.1. All quotations are based on the information provided by the Client, including but not limited to the volume of Goods, distance to be covered, and accessibility of premises.
4.2. Quotations are valid for a period of 7 days from the date of issuance.
4.3. The Company reserves the right to adjust the quotation in the event of:

Changes in the scope of Services.

Inaccurate or incomplete information provided by the Client.

Unforeseen circumstances such as restricted access, additional Goods, or delays caused by the Client.
5. Payment Terms
5.1. A non-refundable deposit of 25% of the total quoted amount is required to confirm the booking of Services.
5.2. The remaining balance is due immediately upon completion of the Services unless otherwise agreed in writing.
5.3. Accepted payment methods include cash, credit/debit cards, and bank transfers.
5.4. Failure to make timely payments may result in the suspension of Services and/or additional charges, including but not limited to interest and collection fees.
6. Cancellation and Rescheduling
6.1. Cancellation Policy:

Cancellations made more than 4 days prior to the scheduled Service date will forfeit the deposit.

Cancellations made within 2 days of the scheduled Service date will incur a cancellation fee equal to 50% of the total quoted amount.
6.2. Rescheduling:

Requests to reschedule Services must be made in writing at least 5 days prior to the original Service date.

Rescheduling is subject to availability and may result in additional charges.
7. Liability and Insurance
7.1. The Company's liability for loss or damage to Goods is limited to a maximum of AED1000/—per item or package unless a higher value is declared by the Client and additional insurance coverage is purchased.
7.2. The Company shall not be liable for:

Loss or damage arising from natural deterioration, moths, vermin, or inherent vice of the Goods.

Loss or damage caused by war, terrorism, acts of God, or other force majeure events.

Indirect or consequential losses such as loss of profits or opportunity.
7.3. The Client may opt to purchase additional insurance coverage for the Goods. It is the Client's responsibility to obtain such coverage if required.
8. Client Responsibilities
8.1. The Client shall:

Ensure that all Goods are properly packed and secured unless packing services are provided by the Company.

Remove all personal valuables, including but not limited to jewelry, cash, securities, and important documents, prior to the commencement of Services.

Provide accurate and complete information regarding the Goods and any factors affecting the provision of Services.

Ensure adequate access to all relevant premises and obtain any necessary permissions or permits.

9. Prohibited Items
9.1. The Company will not transport the following items:

Hazardous materials, including flammable, explosive, or corrosive substances.

Perishable goods subject to spoilage.

Illegal items or substances as defined by UAE law.
-
Live animals or plants without prior written agreement.
9.2. The Client shall indemnify the Company against any claims, fines, or legal actions resulting from the inclusion of prohibited items in the Goods.
10. Delays and Force Majeure
10.1. The Company shall not be liable for any delays or failure to perform the Services due to circumstances beyond its reasonable control, including but not limited to:

Adverse weather conditions.

Traffic disruptions.

Governmental actions or restrictions.
-
Labor disputes or strikes.
10.2. In the event of such delays, the Company will make reasonable efforts to inform the Client and reschedule the Services at the earliest convenient time.
11. Dispute Resolution
11.1. In the event of any dispute arising out of or relating to these Terms, the parties shall first attempt to resolve the matter amicably through negotiation.
11.2. If the dispute cannot be resolved through negotiation within 7 days, it shall be referred to mediation in accordance with the rules of the Dubai International Arbitration Centre (DIAC).
11.3. If mediation fails, the dispute shall be finally settled by arbitration under the DIAC rules, and the decision shall be binding on both parties.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Dubai, United Arab Emirates. Any legal actions or proceedings arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.
13. Amendments
13.1. The Company reserves the right to amend these Terms at any time.
13.2. Any amendments will be communicated to the Client in writing and shall become effective upon such communication.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with any service agreement or quotation, constitute the entire agreement between the Company and the Client and supersede all prior understandings or agreements, whether written or oral.
